EAST TEXAS HOG DOGGERS FORUM

I went last night with my buddy Jake to a new place he got to hunt recently and made a round. He had gone over there for the first time last Monday and caught 2 hogs so we were hopeful, but didn't get anything. That part was ok. When we were just starting back to the truck we heard a 4 wheeler on the neighbors property and it parked just inside the woods so we just kept going since we were not doing anything wrong and we and our dogs were all on our side of the fence where we had permission. We loaded up and were pulling out of the gate when a 4 wheeler came up the road and pulled over by us. I knew what was probably about to happen, so I walked over there and Jake headed that way after closing the gate. The first words out of the guys mouth were "You know if those dogs cross that fence line they might not come back". You talk about starting off on the wrong foot, so I asked him to repeat himself. He did and I said what are you trying to say? He said if your dogs come over on my place I told my guys, (whoever that is?) to shoot any dog they see. He said that letting your dogs get on someone else's property is against the law and that he had seen dogs over there before and they were chasing deer and even had one down mauling it! I wanted to tell him he must have retarded or crippled deer for a dog to catch them but I didn't. He said if our dogs got over there they wouldn't come back and that we had been warned. I told him that we were not on his place nor were our dogs and that while we would not hunt on his place that hogs and dogs don't know what fences are. I also told him it is against the law to shoot someones dog. He said "well you would have to show it to me". Jake and I were both resisting the urge to say some very rude things and knock a few knots on his head. I was shaking when we got in the truck and when that happens I am really mad and am very close to becoming quite ignorant. Needless to say we won't be hunting over there which sucks cause it's a good place with lots of sign. It could have been handled in a respectful way and while it would still suck, it would have been ok. The guy was a complete jerk about it but we kept our cool and remained respectful to him even apologising for having upset him even though we did nothing wrong. We ended up going to another place and having a good hunt and catching 2 hogs but it kind of put a damper on the evening.

Apologizing would have been the last thing I'd have done. I would have calmly and politely told him that I appreciated his candor. Then, I think I would have let him know the value of the dogs and then explained that if my dogs went missing from around this property I'd know where to come to recoup my loss. And that one way or another I would recoup that loss...then I'd have been on my way.

I would have probly done the same thing.  I hope.  But I would let the land owner know what kind of nieghbors he has.

One of my good friends lead cow dogs got on his neighbors land a couple months ago and bayed his cows. The neighbor shot and killed his dog and is now facing criminal and civil charges. I think by the time he gets drug through both courts he wont be killing anymore dogs....

i wouldnt have apologized for anything, you didnt do anything wrong, and when he told me he would shoot my dogs he would have been waking up looking at the sky, he would have hate he come over there threatening me >:D

I know I couldnt have contained myself in that situation.I would have knocked him on his butt,then when he woke up (that is if I didnt give him a few nudges with my boot)I would have showed him my garmin and how it works.Then explained that he might hear the dogs and know where they are but I could just be right behind them .......and I might have to shoot back for my safety.

I was thinking if it became a legal issue I didn't want to say anything that could be held against me. I should have recorded the conversation on my phone if I had been thinking clearly, he was definitely making a threat when nothing wrong hed been done. I could probably get him for making terroristic threats. popo Trust me, my first reaction was a beatdown, then talk, if he still could.

When he said he would shoot my dogs, that's where I would have lost it. Even in my coolest and gentlest state... anyone that says they WILL shoot my dogs... Well I'm not gunna say. A few people know how valuable my dogs are to me. Those few people would gladly help me bury the evidence.

I'm asuming this took place in texas. Because in Oklahoma if u r hunting with dogs and the dog crosses a onto a neighbor. The dog has the right of way and you have the right to go get the dog. neighbor can say what he wants but any physical threat (shooting, etc.) to you or your dog is on him as long as you keep your cool and the dog is not harming domestic animals (walking past them is not consider harm). my suggestion catch him on a public road or the property you have permission on and let fly just for the threat and hell of it. I have been in a similiar situation. But he wouldnt dare get within reach after the first time i was half way in his truck for threating my dogs.

Thats a shame Levi. Thats why I have trouble hunting a new place where I know nothing about the bordering properties, because those types of people can pop up anywhere.  Glad you were able to keep your cool and not do anything foolish.  If the dogs come up shot, then its to time to take it to the next level.  >:D

Shooting a dog just because it is on your land is a criminal offense. He said that he told his guys to shoot any dogs they say which would be a crime. The discussion that plans out a criminal act is called conspiracy. That is a separate criminal offense in itself and charges can be brought even if they never actually commit the criminal offense that was discussed. So the man and who he talked to may have already committed conspiracy. Allegedly. I think you should report that to law enforcement. ;D I expect my dogs to do their job and they expect me to take care of them with the same level of commitment they show me. The best way to win a fight is to let someone else do the fighting.

Doesn't that fall under terroristic threat or something? I'd take legal action since you had a witness. Then make some kind of agreement to droP charges that comes out in your favor ;)

I do hope I would have handled it well. But to just come up when I am not doing anything and threaten to shoot my dogs. I might have gone straight to laying of hands.

Im glad you kept your cool because a couple of years ago that same thing happened to me and a buddy, except this guy was shooting at our dogs. We loaded up all the dogs we had and went looking for the rest of them. Then we ran into him and it wasnt good. I told him if he would of shot my dog i would of beat his head in on that dirt road! Then i snatched my dog up and put him on the 4wheeler. I was leaving and he got brave and said that my dogs didnt have no bussiness on his place. I told him thats fine, next time your cows are out i will shot at them!!!

Hire you a Lawyer!!!  They can make anybody's life a living Hell with the right amount of money throwed at em....  Just ask all my Ex wifes their happy.. LOL

What that ole boy needed was a good ole fashioned Texas ass whippin with a cable lead rope with about 4 snaps on it.They tell me those snaps are painful when they are bouncing off of you head.The guy is a coward and should have been treated as such.

Texas Law last time I read it stated that a land owner can only shoot a dog if it is harrassing livestock, Cows, Horses ect and in the defense of the livestock. If someone just plain ol shoots your dogs for being on the wrong side of the fence I think you got yourself a good ol case of animal cruelty if you can articulate it well enough. As bad as I hate em you could really push the issue with a lawyer and make the guys life a living hell along with takin him to civil court as well and suing his butt off for liability and damages to your property. The guy up front making a outright threat to you would also be good ammo that he wasn't protecting nothing, just plain ol shootin up a man's dogs. If all else fails...good lord please forgive me for sayin this one but ....Tell the Humane Society and let them start banging drums and lighting candles. LOL their always up for a good fight. Just tell them your dogs was lost and was making the great journey home to you and little suzy..

FYI here is some good reading:
The precedence for this was set by Bueckner v. Hamel in 1994, http://www.animallaw.info/cases/caustx886sw2d368.htm. "Texas law allows persons to kill without liability dogs that are attacking domestic animals. However, the attack must be in progress, imminent, or recent. This defense does not apply to the killing of dogs that were chasing deer or non-domestic animals." This case is essentially identical to what is being proposed, except the hog dogs weren't even chasing deer, just running past a feeder.   

   

2 years ago a buddy of mine got his hog dog shot and the man called him and told him he shot the dog. They met up in town and he thru the dog on the Walmart parking lot. My friend got the liscense plate number and tracked him down and took him to court. He asked me to go as a witness and we lost the case. The man lied and said the dogs were chasing cows and we had these dogs 100% cow broke. The dogs were running a hog at the time of the shooting but it was his word against my buddies word. My buddy video taped the dogs walking around the cows and the cows actually chased the dogs and the dogs dodged the cows. tHe judge threw out the case because she said the dogs should of been leashed anyway. The man did admit that maybe the dogs weren't running the cows. I think we could have won if it was trial by jury.

You did right Levi,.....remember this.....NEVER argue with an idiot.....people that don't know you may not be able to tell the difference. Talk to the landowner where you were hunting...may not help a bit, but it just might too. I might also take the idiot a copy of the law about shooting dogs if you can get it.

Never argue with an idiot? I disagree. You just have to communicate in a manner that even an idiot can understand. Take a foot long chain and fold over the end and hold that end. That way it is not long enough for them to take away and use against you ;D It communicates your argument effectively so even an idiot can understand ;D
