Had a sit. dog was wounded and climbed out of bank of river on neighbors prop. went to retrieve my dog and talked to the man that leases the land for grazing, well he went to the owner and lied his ass  off about my dog, little does the guy know that I know the owner, and when I show him how bad my dog was toreup (had to carry him out and patch up quick) this guy that lied I hope will be looking for new grazing for his cows, just seeig if anyone else might have this prob. we are currently looking at agriculture tresspassing class c misd.

If u know the landowner y are u getting charged? Can a rancher file charges without owners permission??

Maybe the man has a "surface' lease as opposed to a "grazing" lease. If he has the surface lease, he controls the access regardless if the landowner says it is okay. At least that is my understanding...

Dont know that much about the law and such, but it may be a good idea to take some picture of your dog where it is cut up.  May be able to show the judge it was an emmergency sittuation and that farmer John is just being a butt.

He just has grazing rights, I have not talked to the owner yet lives out of town, after the guy lied the owner is going to press charges, he said our dogs were chasing his cows and that we were actually hunting on his property, which we  were not just getting one dog, our dogs dont trash at all run them thru cows and deer daily never any prob. no further than 100 yds from bank I went and talked to the game warden already he is going to wait until I talke to the owner before giving a ticket which is good on the game warden part. Going to take owner hunting and show him we have about 80 head im going to let them go in the  area just to show him his grazing boy is a damn liar.

I have dealt with a situation that is a little like yours.  I had a cow man on a adjacent property shoot at our dogs and he didn't know that I knew his boss who had the surface rights, grazing and hunting.  We confronted the guy that did the shooting and he claimed they were chasing deer which we knew was a lie because we had seen the hog they were on, he was not planning on us standing in the road when he came out of the river bottom so he was stuttering a bit and you could just tell he was lieing.  Things got a little more tense because we had one dog that never came back in and we thought was dead.  The dog was found cut down the next day at a neighbors house luckily.  I called the land man and a short while later we got a phone call appologizing.  Luckily no dogs were hit but just another case of lieing and crooked people making harder then it needs to be.  I hope everything works out for you.

Well thats what I figured  also talked to owner to get the stories straight, going to get together and confront the man that lied, the owner only heard one side of the situation, the bad thing about it all is that the dog was mine but my friend is the one who is going to get the ticket, I was still in bottom with hog and asked him to get her. Hope this all works out.

Hope it works out. Keep us posted on the outcome. I am curious as to what happens. Sometimes people like that need a little "In-house" justice. Just to make sure they are straight if the situation occurs again.

Well no tickets after game warden talked to the guy that was not honest about the situation, he changed his story so this worked out for everyone here.
