Been looking like mad to find and inform myself on it and cannot find it to save my life---I did read it on the scrolling notes at the bottom on Fox35 news, but I cannot find any article. Now to charge me with a crime you would need a search warrant to do either.. Just sayin ;)

Ok here is the short version.. To investigate a crime without a warrant you can enter upon property that is not gated or fenced to make contact. To search the premises you need a warrant, with the exception of exigenet (spelling) circumstances, or to conduct an officer safety sweep (which really wouldnt be relevant in this case. Now if you can see the crime from the roadway or place you can legally be, you dont need the warrant to seize evidence (plain sight doctrine). If your yard is fenced and animal control (aspca) what ever they are called in your county comes knocking on your door tell them pound sand and time to leave. Unless they have a legal reason to be there than cant refuse to leave.. Just remember youll never win an arguement on the street, be polite tell them they dont have your consent and that youd like them to leave. Theres alot more to it, but if you want to kow ask them why they have the right to be there, and then do some research on the topic. there is a bunch of case law out there, and most of its availible on the net. The way I took the article that it was County enforced not State wide, am I missing something? I wish I had time to keep up with all of the Fl. Bills they are trying to pass. This organization http://www.dogsdeservebetter.com/ is fighting to have the law passed in the majority of Fl counties. Starting in the major populated areas, Then it will be very simply put into state law as it will already be passed in most counties. That is the so called home county of the so called "Central Florida Dog Hunters Association" and not a peep from them. Not even blip on there outdated webpage. The wall is coming down one stone at a time! An ordinance passed Tuesday, April 10, 2012, in Lake County bans pet owners from tying their animals to a single object with a chain, rope or leash. TAVARES -- Lake County commissioners have unanimously passed an ordinance that prohibits tethering or chaining dogs, except when their owners are outside with them in the yard. County officials said they plan to educate the public about the new rules first, before starting to issue fines in November. Those who violate the anti-tethering ordinance could face a $150 fine after a warning, and could be fined $500 for each additional violation within the next five years. Dog owners could also be hit with a $500 fine if the dog is injured, and a $1,000 fine if the dog dies while tethered. I was reading in our paper yesterday that the ASPCA was so kind to donate 10 Grand for our county Animal control people could go to school to be Animal cruelty Investigators. Give them a title like that and they will find a mission to use it for and that will be the easiest one. That group won't be happy until no one can hunt, own dog's to hunt or own guns.

In the north end where I live it is more rural and the sherriffs department is made up of plenty of local country boys. If your neighbors don't complain there is nothing to worry about.
In the south end people live closer together and typically have more money and/or time to worry about everyone else is doing. It is neither a chain, rope or leash....this is silly that as responsible dog owners we have to put up with that mess. We do not chain our dogs up but if that is one's preferential restraint so long as the animal is taken care of it is none of my business. I was talking last night with my mom who is my neighbor and had her.own run in with the animal control, she was good with them until the guy demanded her ID at which point she told him to go get a Deputy and take the weiner dog that would come and go if he could catch her outside the fence... Are AC in you area allowed to write tickets / enforce codes? Ours are not, they can only look after the welfare of the animals and still cannot enter gated property with out the Star Cars at their side, which leads me to this: Hypothetically, if you chained your dogs on the very back corner of a 10 acre parcel, that with a naked eye you cannot see the animals, are they allowed to use binoculars to see the animals from a public road (lets say there is only one road out front, everything else is inacessable)?? Or at that point is that an intrusian of privacy and overzealous patrolling? I see no point if the dog has food, shelter, and water. If the fly over in a helicopter or use binoculars its not considered an violation of the 4th amendment.

One of his neighbors called in about his dogs barking too much. The sherrifs dept. called Animal Control. They tried to push the issue about the chains, so he put them all in the same pen. It's crazy but that was fine and legal to have about 11 dogs in 10x10 pen. Animal control got him for not having rabies vaccinations and tags. Animal control took the dogs a week later and killed them at the "shelter". We offered to take a few dogs, but Animal Control had that covered too. If the dogs came up missing during his 5 day warning period, he would pay additional fines or provide information as to where the dogs went. That would only prompt more "investigating", so I left it alone. |
