Title: Upsetting phone call Post by: Dexter on July 06, 2009, 10:15:36 am I got a phone call last night from Em a young lady that i gave a catahoula gyp too a couple of years ago, and she was crying and screaming that Jasper was dead,
the dog had gotting out of the back yard and Bell County Animal Control had picked up the dog ,then took it to thier so called holding facility and put the dog in a crate in a barn???and she got out of the crate and got ran over on the road this was i highly trained personal protection dog trained be myself that would rather die than let any harm come Em(19) and her momma i thought the animal control (pos) was in for the best welfar of the animal and are responcible for the animals health as well will in thier custody we need help in making this wrong doing right Dexter Title: Re: Upsetting phone call Post by: Circle C on July 06, 2009, 10:25:29 am Quote we need help in making this wrong doing right Dexter, Both parties failed this dog. You have to consider that if the dog had been contained originally, it never would have been picked up in the first place. It just as easily could have been hit by a vehicle while roaming outside of Em's home. Regardless, sorry to hear about the dog getting killed. Title: Re: Upsetting phone call Post by: wrangler on July 06, 2009, 11:25:36 am While I would have to agree with Circle C on the fact that both parties must share in the responsibility of the fate of this animal, I would have to say that the Animal Control may still be liable for the end result, as the animal was in their care, custody, and control at the time of the animals’ death. As with a humane that is taken into Police custody, a certain level of responsibility and care are assumed by that agency. Please don’t misunderstand me, I am in no way comparing an animals’ life to the value of a humans’ life, just using it as an example for the assumed level of responsibility.
I would make sure that you have all of the facts regarding the incident from both sides. Most Animal Control Agencies do their best to insure the animals in their custody are housed in a safe manner and can reasonably prevent the animal from injury or escape. I would make sure that the Animal Control Officer who picked up the dog followed procedure for impounding the animal and if he/she did not, then you might have a leg to stand on as for holding them financially responsible for the dog. You said the animal was placed in a crate in a barn? and it states in Sec. 3.02 “3.02 The Animal Control Officer or any peace officer shall be authorized to capture and impound any stray cat or dog and place said cat or dog in an authorized animal shelter. The Animal Control Officer or any peace officer may issue a citation to the owner of a stray cat or dog whether or not the animal is subsequently impounded.” Also in the definitions, an Animal Shelter is defined as; 1.03 "Animal shelter" means any facility used for the purpose of impounding and/or caring for animals that is operated by a humane society, another governmental entity, a private entity, a veterinarian, or Bell County, and which meets all standards for such facility as required by law and the Texas Department of Health.
