Though I agree with several post here, and love a little old fashion justice, I also like proving that I am right, creating a paper trail, and getting my money back.
Do you know how easy it is to file and win a civil suit in small claims?

Civil suits in small claims is a waste of time, there is no way to force him to pay you. I have filed a couple of claims before and the 2nd time the defendant didnt show up. The judge talked to me after all the paper work was finished and I asked him "whats next? How do I get my money" he said "there is absolutley no way to force him to pay". He said to file a Abstract of judgement and all that would do is show up on his credit report as money owed. Would have been more rewarding to me to drive and whoop his A$$ and would have been cheaper too.
