Its not if you were not in the military, its if you ARE in the military but NOT in uniform is when you dont have to salute, unless at a function that requires the wear of civies and only during reporting to the formation leader and unit commander. FM 7-21.13 governs army customs and courticies and part can be found AR 670-1, which governs wear and appearance while in and out of uniform and what customs are required when out of uniform.
