Monty, go talk to principle, i'm surprised that at the ER they didnt get law enforcement involved. They take it pretty seriously these days when a kid hurts another one. They should suspend that kid and maybe send him to an alternative school. Its a shame kids cant take care of it themselves like we did growing up, but now, if your little fella makes him pay, I'm afraid the school will come down on him hard.
