I believe it depends on her side of the story.  A lot of what courts rule on is what a "reasonable person" would do.  When asked about beating the dogs what if she replied.."I kept hitting them until they let the hogs go".  That may be reasonable.  I would think most people would do that also.  Like previously mentioned, what if a bat is all she could find?  I doubt she had a break stick handy.
