This is a quote from the article. "Texas Attorney General Greg Abbott, for example, citing recent Supreme Court rulings, said the proposals being discussed in Washington are unconstitutional. If any were to be approved, the feisty chief law enforcement officer vowed to take the federal infringements to court and have them thrown out. "I've been to the Supreme Court twice," Abbott said in a recent interview with 1200 WOAI. "I can tell you that these laws that try to restrict our gun rights violate the Second Amendment guarantee of the right to keep and bear arms. The U.S. Supreme Court has spoken on this issue twice."And that was my point. If laws or orders are put in place then the states can challenge their constitutionality. The states can't make a law that it is illegal to enforce a federal law. The states would simply request an injunction to stay the law or order pending litigating the issue.

There can be state laws and federal laws applicable to the same issue ... such as guns or hunting or marijuana. In Cal and Col the states have legalized marijuana. The problem is that it is still a federal offense. Currently, the feds are saying they are not going to enforce the law. But they could if they wanted to.
What the states can't do is pass a law that criminalizes the enforcement of a federal law, which is the point I was making. The states have to litigate the legality of the federal law if they feel it is unconstitutional.

So like I said basically it only applies when it is in the favor of those who are supportive of it but not equal across the board

They only have the authority that we allow them to take the constitution was written by brilliant minds that had to deal with a tyrannical government and saw first hand the underhanded cowardly dealings for power grabs etc. It was written in a way to where if the people kept the core beliefs stationed around the constitution and stood by it we would not be in the situations we find ourselves in today. We need good elected officials that are not there to pad their own pockets even more but to follow the laws setup by our founding fathers and get the junk that has become a politician out. They have their own agenda that they want that does nothing but cause problems for us as a country and individuals as well. There is no logical explanation to the situation we find ourselves in except for greed and the desire for power. There are very few elected officials that have the nerve to stand up and stop what is going on that goes for both sides Democrats and Republicans.

Those that do stand up, dont last long in office. Our founding fathers gave the people the right to kick the officials out once their power got to big and when they no longer where for the people. It says the gov gets their powers from the people. We hav givin them a-holes to much power n the ries need to be yanked back and start the reversing their vial unconstitutional corrupt beliefs n political agendas. But with all the gutless n chicken poo liberalistic people in this country, removal will hav to be by force. We as true americans cant get just service nor enuf to band together to make a difference with petitions and would b hard pressed to find enuf will to fight and die for their freedom and the freedoms of their family n friends. Being in the military is no longer about fighting for americans freedom, but the freedom of political intrests, money and greed. Cull them ALL, let GOD sort them out n send them to HE!!

TEXAS TO JOIN WYOMING: FELONY CHARGES FOR ENFORCING NEW GUN CONTROL Texas state representative Steve Toth is filing legislation for a "Firearms Protection Act" similar to that which we saw in Wyoming. This law will make "any federal law banning semi-automatic handguns or limiting the size of gun magazines unenforceable within the state's boundaries." Not only will this put Texas shoulder-to-shoulder with Wyoming in making it a felony for anyone--including federal agents--to try to enforce new gun control, but according to the Tenth Amendment Center it is in perfect harmony with the actions of Texas Attorney General Greg Abbott, "who has already filed over twenty-three lawsuits against the federal government." More good news--representative Toth is newly elected, which means he isn't wasting any time. He is taking it to the gun-grabbers instead of sitting back to see what happens next. Toth puts it this way: "We can no longer depend on the Federal Government and this Administration to uphold a Constitution they no longer believe in." The message is simple: "Don't Mess With Texas," and particularly, with Texas' gun laws. http://www.breitbart.com/Big-Government/2013/01/15/Texas-to-Join-Wyoming-Felony-Charges-For-Enforcing-New-Gun-Control
