I have a small bay pen outside the city of iowa park,tx. the other night we were reported by one of the neighbors for "attacking pigs in a cage." we were not attacking anything, just baying and running back in the pen, just like any bay contest would do. the sheriffs department came out and talked us and wqe talked and they left. well today i got a letter in the mail from peta saying that they there informant was keeping a close watch on us and that next time they will be coordinating with local officials to prosecute. now as i understand it there is nothing illegal about baying in a pen correct? i dont really want to quit using my pen because we have some young dogs we are trying to get going. any advice on what to do would be appreciated

My understanding is-
baying in a pen is legal
biting in a pen is illegal, if they get a photo of you with a dog biting a hog in a pen, you may have a tough time on your hands.

Pretty good summation, Chris....... If I were you, I would get to be friends with my local Sheriff, Game Warden, DA and the TAHC general counsel (good guy named Gene Snelson). If for no other reason than making sure that they are familiar with the current animal cruelty laws and your training methods. Fact is that your doing nothing illegal by baying BUT you could be compelled to appear and prove yourself innocent.... That's how these PETA "do its" work, by turning our legal system into one requiring us prove our innocence rather than the other way around! so if they take a picture of one of my bay dogs biting the hog to stop it im screwed? because the letter specifically says "pit bulls"

biting is biting as far as they are concerned. However, they won't call it biting, they will say your dog was attacking the hog

My understanding..................again just the way I understand the laws.
You can not put a dog in a confinement with any other animal or dog where the two can not get away from each other with the intent of one or the other causing harm one or both. This is a very broad stroke of pen here, it leaves it up to law enforcement and peta to deciede what they think your entent was. I also believe that bay pens are only allowed to be used where they are being used for field trials and nonprofit type groups.
Again this is the way I understand it.
Regardless of bay pen laws, there are new laws about containing hogs and transport. You have to be certified to contain wild hogs and meet state guidlines in how they are contained.
I will say that a letter from Peta means nothing since they are not a gov organization. Can they cause you problems, YES for sure. There is a case here in Kerr County that is still on going now after almost 2 yrs of useing a rodeo arena as a bay pen for personal use.

A friend has a huge concrete tank that one side collapsed on years ago, non repairable. So he took welded wire and covered the hole and made it a hog pen. It is round about 60 ft across with 12 ft sides, we had 1 boar hog in it and he had only been there 2 days when Animal Control showed up unanounced and said he had 48 hrs to get rid of the boar and could never use the pen again to house any kind of animal. Very unclear about why but very clear that charges would be filed if this was not changed.
Got to be careful and cover your back at all times.

Jay,
If it's the concrete tank I am thinking of, how in the hell did the animal control know about a hog in there. Its 1/4 mile from the road... Or maybe I am thinking of a different person with a similar setup?

That far from the road, how in the heck did anyone know there were hogs in that pen? I know the pen you are talking about, and it would have to have been called in by somebody. I'm really feeling my violent tendencies today, but I'd be trying to find out who reported it. To my knowledge, that pen was used to hold hogs so that they could be taken to a terminal facility.

Yes its the tank ya'll know. I have several ideas about how and who the report may have come from. Problem is no way of proving anything. Someone did report it for sure since they drove straight to it and it happend to be on the only morning the electric gate didnt close, so they claim. No one was home when they made thier inspection.
So we dont use it anymore.

Let me tell you how easy it is to be labeled.During Ike I was coming back and forth feeding my dogs which were safe and covered.Well dogs that were loose just started showing for the fact i started pouring feed on my porch cause i knew they had not eaten and no tellin where the owners were.Well i got a visit from a lady declaring PETA.I asked her where the hell she was when they were starving and gave her about 3 judges several lawyers,which whom i hunt and everything i could think of.No return but I was just a guy taking care of strays who just had the crap scared out of them and got labled for neglect.My lawyer sent a letter to this b!@#$ and let her know if she show up for no reason we have problems!Moral is be careful guys.

I have my own ideas on where those hogs ought to end up, but it wouldn't put dog hunters in a good light. Its best that I just keep my mouth shut and keep us in an upstanding state - but I bet a few of you know what i'd do.... and then what i'd do afterward. I just know I should have been born Gotti!
