What if a breeder says "if you are not 100% satisfied with the dog return it for a full refund," states this on their website, signs a written contract, then the breeder decides when you are not satisfied that you did not feed it the right dog food or did not let it "roam" around enough that you are not getting a refund?  What would some of yall do? What would your OPINIONS be to resolve the issue?  I also understand that there are not guarantees in dogs but the breeder is well known and respected.  Just asking for everyones 2 cents.

My opinion is if a breeder has a written or verbal agreement or contract that he will not honor, the individual is nothing more than a common thief and should be treated and viewed by others accordingly.  I think the action of the breeder shows that he doesn't really have any regard for his dogs or customers and that he is motivated solely by his self interest of making money.  I would try to handle it with the individual first, legal action next (not for the money but for the principle of the situation), then go to plan c.  At the end of the day untrustworthy swindling people have to live with themselves and will eventually in some form or fashion get what they have coming to them.

He needs to keep his word. If thats your sales pitch 100% guaranteed, stand by it. I have 2 from the same breeder and if mine didn't turn out as stated, well I would want my money back. It's just not good buisness. Let us know how it turns out. JT

In my thinking if he's a real breeder he knows there is what I think to be a 30% chance the two will not match    So if he says he will not refund your money he NEVER WAS GOING TO ANY WAY it was all bs contract or not     I HATE THIS      IT's MAKE'S GOOD BREEDERS LOOK BAD  I breed and sell many dog's a year and fully stand behind my dog's and know for a fact just because a dog will hunt with me does not mean he will hunt the same way with you a good breeder will be prepared for this

i guarantee  mine .....i have  gotten some  back  in  pitiful  shape ...long  as  there  not  badly crippled  i  love  to  buy  em  back  after  someone  has  raised  em  up ....... even after a  year  i always  like  to  get a  shot  at  buying  one  back  if  the  price  isn't  too  high ...... truth  is  i can  usually hunt  em a  little  while  and  probably  double  what  i  gave  for  em  back ..... some  i  have  kept  for  myself ..... if  the  dogs  are  bred  right   they will usually  make  some  kind  of  hogdog ......

If you have a written contract from the breeder file a small claim civil suit in J P court.  The filing fee is generally around 60.00 plus a service fee.  You may can even file it in your county if the guy called, delivered the dog to you or negotiated the agreement in your county.  You should be able to get your money back.  PM me if you have any questions.

Civil suits in small claims is a waste of time, there is no way to force him to pay you. I have filed a couple of claims before and the 2nd time the defendant didnt show up. The judge talked to me after all the paper work was finished and I asked him "whats next? How do I get my money" he said "there is absolutley no way to force him to pay". He said to file a Abstract of judgement and all that would do is show up on his credit report as money owed. Would have been more rewarding to me to drive and whoop his A$$ and would have been cheaper too.

Might as well take it as a lesson learned and move on .  Back in the day I ran from breeders that uttered them words !  Some may produce good dogs but most are just dog and puppy mills !  I know a few that are ok but you can count them on less than one hand.

They can guarantee you the money may be in the form of a lien. I had a 500 dollar toyota I was getting a motor put in it by a so called friend. Well he needed some drugs real bad and sold the truck, and told me someone stole it. Well I sued him in small claims and won the cost of the truck which he deemed 2,000 and 500 for the motor. Well he never paid me so I kinda wrote it off then 10 yrs later get a call from his fixin to be ex wife that they couldn't sell their house, land or shop till they paid me we went back to court and the judge charged him interest also for the last 10 yrs made off with 9,000 for a 500 dollar truck. Damn good huh Grin Grin

this is a little different but i just brought 2 strike dogs off this board for 1100 dollars with a week trail money in hand dogs are suspose to be silent and some bad ass dogs. took them hunting and they didnt meet what i thought 1100 dollars should be so i called the guy back and told him i wanted to might and bring the dogs back he said that is fine but now he is not answering his phone. i have his driver lincering number what can i do to get the money back besides just beating the number 2 out off him

The number 2 option is probably your best bet. lol  You could sue the guy and may have some success but is always a good idea to have a sighned written agreement.  Some counties law enforcement and the county attorneys office might pursue criminal charges against these crooks.

With a judgment on your credit you can't do anything until is paid. I agree on legal justice.

If the defendant did not show, and you had any supporting documentation at all, you should have received default judgement as leverage for a lien against the defendants capitol property. IE: a lien on his home. It would not guarantee immediate payment BUT no title can be transferred until liens are satisfied. Even if the dude died, the lien would have to be satisfied before the estate could be rectified. Plus, its a nice little, "I got you by the balls, you daddy didn't marry mommy" kind of statement.

I got a dog from a breeder that said "If your not happy with the dog for any reason bring it back." I just didn't like the gant of the puppy and she let me get the breeders pick of the litter and then gave me another pup free! For me I may not have got my money back but I did get double for my money. that was her guarantee and she stood by it! I would think its hard to give cash back once you have it expecially if your the one who picked the dog... just my .02
