But the knife is about on the person or they could not sell a butcher knife. If the knife is the only thing you have any judge will toss that out. Now the bad guys carry guns.

Dub,I don't get that "now the bad guys carry guns" that is offensive to me unless im mis understanding you.....I carry a gun and know many who do are you saying us that carry guns are bad guys?

A person commits an offense of unlawfully carrying a weapon if the person intentionally, knowingly, or recklessly carries a handgun on or about his or her person unless the person is on one’s own premise or premises under the person’s control or inside of or directly en route to a motor vehicle that is owned by the person or under the person’s control.

It is unlawful to intentionally, knowingly or recklessly carry on or about one’s person a handgun in a motor vehicle if the handgun is in plain view or the person is engaged in criminal activity (other than a misdemeanor traffic violation), prohibited by law from possessing a firearm or is a member of a street gang.

This might clear up some confusion about carrying a concealed handgun in Texas.

I have spoken to plenty of officers who aren't even clear on these laws.....that's what happens when they don't pay attention in legal update classes!


just out of curiosity, how many legal update classes have you sat through?

winner winner chicken dinner. As a police officer i will tell you that a "hunting" knife is fine to have on your belt on in your pack while hunting. no different than wearing a pistol on your belt while hunting. however, if you wear that pistol or big knife on your belt and go in walmart, or any other store, in the public, expect to get to have a conversation with a cop. a little bit of common sense goes along ways.

if you do happen to get stopped and some fresh out of the academy rookie thats looking for his first weapons arrest and you have a big knife in your truck. tell him this magic phrase, "im a collector, i just picked it up, it will be displayed in my home"....not against the law to be a collector

Dub,I don't get that "now the bad guys carry guns" that is offensive to me unless im mis understanding you.....I carry a gun and know many who do are you saying us that carry guns are bad guys?
  If you have a gun you are not bad guy. But if you are a bad you have a gun not a knife. Who brings a knife to a gun fight? I am not talking about hunting. But a cop pulling over someone trying to decide if they are a thug or not. I have a gun rack in my truck. But you seem shady Grin

bailey - if we are in transit to a hunting spot and get pulled over (with dogs in tow) we could be arrested for having a large knife in possession?

Cops can arrest you for dang near anything....  It;s the judge and jury that have to sort it out.

My policy has always been to be upfront with the officer. If pulled over at night, I roll ALL the windows down, turn on my interior light, and place my hands on the steering wheel. Then I try to have a polite dialogue with the officer. When questioned if I have a gun or knife in the vehicle. "Yes, officer, I do have both a hangun/rifle and a hunting knife with me. I am heading out in hopes of eradicated some more destructive feral swine,otherwise known as sus scrofa.."  Grin   If they ask to verify serial numbers, I oblige...   Sure I can take the hardass approach, but it doesn't get you much of anywhere.

Now, if they wanted to be an ass about things, I go ahead and get their name and badge number as well as their chief's name and contact info.  Probably only happened once or twice in all the times I have been pulled over.

Come to think of it, the biggest A-hole I have ever run into was a trooper in the Huntsville area, last name Jeter.... He is now a Texas Ranger.  I asked some buddies at Walker county about him. Said he would write his own mother a citation...  Some of the cops, no matter how polite you are, are gonna be jerks.   A year or two later, Mandi and I had to go to Waller county, in Hempstead, to give a statement about finding a dead woman. We got on the subject of hardass cops, and told the story about our run in with him. The officer asked if Jeter was the trooper... Apparently word travels about the infamous ones.

I beleive the chance of arrest depends on a lot on the situation and officers state of mind for example; time of night, if it got some Grin before work, and your responses to questions. I have been pulled over while in route to hunting with dogs in tow and he wanted to know more about the dogs and hunting than anything else. I've been pulled over with rifles in cases in the back seat and knives in plain view. Also I wouldn't ride around Houston with the gear in the truck (keep all my gear in 1 large bag) but then most of us live in small towns were the hog problem is obvious and we aren't driving '88 Olds with 24" rims and a bump system (not trying to stereotype but come on). I probably should remove the switchblade....

It all boils down to officer discretion. Yes technically you could be arrested for having a long blade knife even though you are going hunting. 99% of us want bother you because we know its a bad case and we have to maintain credibility. The fastest way to loose credibility is to start making bad cases. Then you end up on the wrong end of new case law handed down from the supreme court. But remember, their is always that one percent out there. So be careful how you act and be concious of what you're saying.

One last thing. Most people That get arrested for stupid stuff, "asked" to be arrested. Rule of thumb: don't pi$$ off the police. Lol

Nah man, I like cops. Most of my runnin buddies grew up to be oilfield trash or cops. I couldn't hack it in either one of those jobs as I dont like being managed. I got much respect for the boys in blue
