I am working on a seminar paper having to do with right of retrieval throughout the states, and I need a book to illustrate the legal issue. So, do any of y'all know any books that bring up right of retrieval or more likely trespassing. Preferably with hog dogs, but I doubt there is much literature on the subject at all. Other things that might work would be: Trespassing to retrieve wounded animal; cows or horses getting out and on another's land. Thanks in advance.

Im pretty sure there's not many books that contain much info about state dog laws being as most laws are different from county to county and state to state, might can check the states dept of ag and forestry websites or usda website to point you in the right direction, if you know someone that works in the insurance business mainly land and livestock they might be able to help, I'll say this about MS and LA game wardens and sheriff deputy for that matter, over half of them don't even know the laws pertaining to dogs, if you go through with this it could be really helpful for dog hunters in general to find out the laws, also MS does not have a right to retrieve law, you have to contact a law enforcement official to escort or accompany you on private property to retrieve your dog if the land owner does not give you permission, I gotten a citation for trespassing and almost went to jail for destruction of private property when an hole in the butt called the law on myself and some other friends claiming to be the over seer of a piece of property that belonged to my bank that I had written permission to be on from my wife's aunt who was the bank president, but didn't have the actual paperwork with me and it was a Sunday night, he brought the sheriff deputy to our trucks but wouldn't get out of his vehicle or even roll down his window so I could see who he was, so I was driving out I hummed a speed square that was in my floor board at his window and just my damn luck it knocked the window out, I wasn't intentionally trying to bust his window but had to go with it once it happened, I got to see who he was and had a charged pressed against me that was dropped the next day when the bank pressed trespass charges on him and for tearing up their roads on a four wheelers, and deer hunting in there, so yeah, don't think you can legally retrieve your dogs in MS without the help of the law because we used that excuse and even called a game warden friend while the deputy was sitting there and bc I didn't have the paperwork stating I had permission to be in there we were considered trespassers until I could get things cleared up the next morning...

Please keep us updated on the progress of this paper, I would really like to know the different state and county laws...

I doubt you will find any Hunting dog books about right of retrieval (but you never know), I think your best bet is to google it, and then try and find the biggest cases that show in that search and then looking up the actual court docs and see what precedents were used (if any) and how effective they were. There have been some big cases these last five years or so with big money being awarded to dog owners due to landowners not letting them get their dogs and or shooting them.

Good luck either way and like Goose said I am interested in how your paper turns out.
