Title: Roops Tire in Cleveland TX

I strongly believe in letting everyone know when a company is doing good folks wrong. I have taken it as a personal vendetta to shut these guys down...
So my wife takes our car to Roops to get the tires balanced, had a little bounce. Only reason she went there is because Smokeys was closed, which I'd have to add is a great shop and I would recommend to anyone. Anyways, "a new guy", or so they say,  takes the front tires off, balances them, and puts the passenger side tire back on, but instead of starting the bolt and then hitting it with the impact; he sticks the bolt in the impact and goes at it. But he doesnt do this with just one, he does it with all of them. Wife says he ran the impact for a good minute on each lug nut. After he crossed threaded all of them their mechanic comes up scornes him then sends him home. So now all the bolts are stripped out, and the hub is ruined. This is not like a truck; it has studs that screw through a deep rim, then into a hub. Hub is ruint ($159), studs are ruint ($5.00 each), and its a Saturn so parts are harder to come by, and I have to get another front-end alignment ($100). They get three studs in there, cross threaded and jammed so the car can be driven home, My FAMILY **wife and 2 kids**. I call them up the next day, asking WTF, long argument short, they say they are only responsible for damages to tires and not any other part of the vehicle.

Are you kidding me??? This is a business that is always busy.. Because their so CHEAP!!! I'm telling everyone, and still have half a mind to go put hands on a few of them. If you care for your families safety, and your pocket, DONT GO THERE, and tell anyone in our area the same.

So if they take a hammer to the car they are not responsible. It is called negligence on their part. They have a duty to provide properly trained employees, they failed to do so, you have damages. If you go get a lawyer you get either double or triple damages. You can also go to small claims court and at least get double damages. It is state law in Texas. I have the exact laws on my laptop. They are responsible for the actions of their employee.

Its their word against mine right?
And the manager already said it was like that when my wife got there. All of us involved know that isnt the case, but we do know what they will say if faced in court. Obviosly they are out to screw people, so we know they aint honest.

 Same exact thing happened to my wifes mini van at a Firestone complete auto care, She had a blow out and when I got to her to change the tire the lugs snapped off, there was no way to change the tire. needless to say they replaced all 20 lugs and nuts for free and gave us a free alignment. I threw such a fit with them that now when they pull my name up on the computer it say's in bold letters, air tools for disasembly only. They are not allowed to put the rims back on with a impact wrench and Ill tell ya I watch every move they take when it comes to the family ride. Raise hell with them, call the better business bureau if you have to.

I think the difference there BIGBEN is Roops is a mom n pop type shop. Fire Stone has some back bone and cares for customer service. They know their customers will make or break them.
I called them, got in an arguement, then they hung up. I've tried to call them back numerous times, but they dont answer. I'm gonna try to get off early one day this week and go talk face to face.
Like I said, if they wont deal with me and make it somewhat right, I'm going to do everything in my power to let everyone know what kind of a place they are.

Go pay a lawyer fifty bucks to write them a letter telling them that you are going to sue them (they dont have to know your bluffing). They are a mom and pop shop and cant afford to be sued. truth be known that a law suit will put them out of buisiness. I will guarantee that they will come off the five or six hundred bucks to fix your car, rather than spend thousands "defending" themselves in court. then your out fifty bucks instead of five hundred and you get the satisfaction of watching them jump through their butts trying to satisfy you. I have been in law for a long time and this little trick works.

If it was that way when the car came in they should have stopped and consulted with the the customer anything else would be negligent. You go to borrow a car and you see major damage wouldn't you go tell someone before you drove It? If you drove It they would think you did it. So it would be up to a jury to figure it out. If I was a
on a jury and a shop said it came in that way. The shop is telling me when they took the tire off they noticed it but removed the wheel, balanced the wheel, and put it back on without asking to charge you for an additional repair.  Really the shop expects a reasonable jury to believe that. I new lawyer would love a slam dunk case like that. Just because it is your word against theirs does not mean it a lost cause. But beware businesses support politicians including judges. So be sure to ask for a jury.

I hadn’t looked at it that way, thanks Dub. But it would be cheaper for me to replace the parts and smear their name, than go to court, I think anyways. I aint never sued anyone, and wouldn’t want any more than the repairs cost me. But running a business out of my home town that screws people, that can’t afford it, especially in an economy like we have right now, would be priceless. ;D

The lawyer is one way to get there attention, but a another is to contact the Better Business Buero (SP?) BBB. They will look into it and having a bad mark from the BBB will hurt there business and especially a mom and pop kind of place cant afford that.

If you have full coverage you can make a claim and they will go after the shop. My wife had her tire fall off a day after getting the brakes done. Insurance companies have lawyers that are on salary and will go after every penny they can. ;D Kind of like Pit Bull. Nobody likes them but when they are on your side it is nice. I may just give them a call. You know you could just make a sign that say something like. "I feel Roops tires has done me wrong and they refuse to make it right." That way you are only stating facts. You can feel anything and it is not libel or slander. The fact that you are standing there is because they won;t do what is right. Make sure you run off more money in business that it would have taken to do the right thing. Cleveland is a small community and people's opinions are important to a business. Just make sure you don't make any direct accusations that can be disputed. Then when they ask you to leave tell them you will after they do the right thing.

I greatly appreciate your legal view. Would it be an illegal act to make flyers with a big consumer warning logo on top, then stating below, Roops Tire damaged my vehicle and refuses to repair it. They said "We are not responsible for any damages caused by our employees while working on tires", then refused to talk to me anymore. Be careful when doing business with these guys. Don’t let their incompetence cost you money. 
I'm thinking about making 500 copies and putting them on everything in sight in Cleveland
Even if it is illegal, unless they catch me doing it, I could say they must have pissed someone else off... :)

I am not a lawyer, this is not legal advice. Just how I would think and approach it. I would say something like from my point of view this happened. Keep it factual from your point of view. Then I would put question like would if you were a business and you found this would you take the tire off balance It and reinstall it if it was crossthreaded when it came in?  Or would you want to charge for more work. Spend time wording it so you do not say anything bad but they think it when they read it. Then you can say they deny everything so each person should call the store and ask the store for their side of the story. But you give them questions to ask. Be sure to include their phone number so they can get both sides ;D The phone should be ringing off the wall. So you make sure you say it is your side. Put some questions then tell them to get the other side before coming to their own opinion. If you tell people not to do business with them you might get in trouble. But you can ask if this is the kind of company you want to do business with or that you will no longer do business with them and why.

You can state your point of view all day. By giving the phone number and asking the person reading to get the other point of view is saying it is my opinion and you should get the other opinion. Then form your own opinion. But it is pretty clear from real experience that shops stop and try to get more money fro you any time they find the smallest thing. To Say it came in that way after the tire is back on? That does not pass the smell test.

I am no problem as long as people try to do what is right. I have seen two hit and runs. I chased them down. One ran into a real bad area of Houston that HPD would not go look when I went back to tell them where he was. So I got a tow truck driver to follow me. I even went back got out of my truck to tell them who was driving. The thugs were trying to stare me down. I told them if they did not have the ba!!s to stand up for their actions they did not have the ba!!s to mess with me. I just get really ticked off when people refuse to take responsibility for what they do. The funny part is when my mom was about 60 years old a young man rear ended her and took off. She chased him down and when he got stuck in traffic at a light she ran up, opened his door and drug him out in the street. She is about 5'2" and maybe 100lbs. I come from a long line of real Texans. I figure if I let someone do something wrong I am just as bad as they are. I believe it is everyone's job to protect the public.

That same tire shop had a pit bull in the office that would bite and they would tell of not to go in the office! Not the smatest people in the world! A dog at any bussiness is dangerous I personally don't think its worth the liabilty!

That same tire shop had a pit bull in the office that would bite and they would tell of not to go in the office! Not the smatest people in the world! A dog at any bussiness is dangerous I personally don't think its worth the liabilty!

So that's where Q Bee stays when she's not traveling the world in search of swine.
